Hani's tenure leads to legal uncertainties

THE last five months of Themba Hani's tenure as acting municipal manager of Nelson Mandela Bay Municipality were unlawful, raising questions about the validity of all the decisions he made in that time.

This is according to a report by the city's legal department. It also advised council to ratify all decisions made by Hani from July 18 to November, saying he was still performing the duties of a municipal manager because although his stay was unlawful, it was condoned by the municipality.

However, this could have a major impact on contracts, letters and suspensions signed and authorised by Hani during that period because the council did not formally approve the extension of his contract beyond July 18.

Some of the municipal officials suspended by Hani after July 18 include municipal spin doctor Roland Williams and director of constituency services Dumisani Mbebe.
