ACCORDING to the law of education in South Africa, the governing body of a public school has a duty to adopt a code of conduct for pupils after consultation with pupils, parents and teachers.
The code must meet the legal requirements set out in the various national and provincial education acts and regulations.
Section 20(1)(d) of the South African Schools Act indicates the development of the code of conduct.
Section 8(1) talks about consultation.
Section 9(3) and (4) of the constitution talks about unfair discrimination on the grounds of both religion and culture, which is prohibited.
Section 1 of the Equality Act also defines discrimination.
School governing bodies should take note of the above and other relevant acts.
