LAWYER UNHAPPY ABOUT REPORT

I AM very disappointed with the February 27 page 4 story, "Assault case against councillor dismissed".The reporter never got the facts correct! I am the attorney who appeared for Aaron Nyikilana.The case went on trial.The complainant was not believed by the court! The accused was believed and found not guilty. Why did she not say to the magistrate she got a "R500 offer"? After losing in court and being laughed at by the public, running to The Herald is sour grapes.

BERGSMAN ATTACK: ACQUITTED OF MURDER

I WAS shocked when I read the judgment following the robbery and attack on Jan Bergsman. He had been beaten and stabbed, and later died from these injuries. The two accused were found guilty of robbery only. Really! What message does that give to elderly folk? What will the lousy robbers think?

THIEVES not convicted of murder: how can thieves who broke in and attacked Mr Bergsman not be charged for murder just because he died a few days later and if he was younger would have survived? Point is if they did not break in and attack him he would be alive.This is plain murder.

IN acquitting of murder two thugs who had beaten and stabbed their 86-year-old victim, the judge said the victim would have survived had he been younger. May I ask whether he would have survived had he not been beaten and stabbed?

WHEN WILL ATTORNEY'S CASE BE HEARD?

ATTORNEY Michael Randell was arrested on November 26 2008 for alleged breaches of his fiduciary duties as trustee and member of a school governing body. When will his criminal case be heard? He has not been struck from the roll of attorneys and still represents a teachers' union in labour cases against the Department of Education. Principal Patrick Shelver lost his job and was sentenced.
