THE Port Elizabeth High Court yesterday dismissed an application for a discharge from prosecution by one of the men accused of sex crimes against two girls.
The 47-year-old Bridgemead man is charged with two others – a 39-year-old woman and her 38-year-old boyfriend, both of Parsonsvlei – of sexual assault, causing a child to watch a sexual offence, sexual grooming, sexual exploitation, exposing a child to pornography and failure to report a sexual offence committed against a child.
They allegedly committed the crimes against the woman's foster daughter, who was 14 at the time, and the Bridgemead man's girlfriend's granddaughter, who was 12.
The foster daughter has testified about the incidents.
This week, the granddaughter told the prosecution she had lied about witnessing the incidents, after which she was not called to testify.
Judge Belinda Hartle dismissed the Bridgemead man's application and said she would reveal her reason when she delivered final judgment.
